THE APPOINTMENT OF THE SURVEYOR TO CONDUCT EXPORT GOODS INSPECTION

THE MINISTER OF FINANCE,

Considering ;

That for the inspection of certain export goods, it is deemed necessary to appoint a surveyor by issuing a decree of the Minister of Finance.

In view of:

To stipulate:

THE DECREE OF THE MINISTER OF FINANCE ON THE APPOINTMENT OF THE SURVEYOR TO CONDUCT EXPORT GOODS INSPECTION.

Article 1

(1) PT (Persero) Superintending Company of Indonesia (Sucofindo) shall be appointed as the surveyor to conduct the inspection of export goods.

(2) The inspection as meant in paragraph (1) shall cover:

(3) The inspection of export goods as meant in paragraph (2) point b. shall only apply up to March 31, 1997.

Article 2

The procedure for the inspection of containers and vessels as meant in Article 1 paragraph (2) point a. shall be further stipulated by the Head of BAPEKSTA-Finance (Agency for Export Facilities Service and Financial Data Processing), by observing the export provisions in force.

Article 3

(1) Results of inspection by the surveyor as meant in Article 1 paragraph (2) shall be contained in surveyors export inspection reports (LPS-E).

(2) The surveyor shall record data on notifications of export of goods (PEB)/notifications of export of certain goods (PEBT) already approved for loading by the Directorate General of Customs and Excise which are obtained from exporters from the inspection reports issued, for submission to BAPEKSTA-Finance in the form of electronic data.

Article 4

The rights and obligations of FT (Persero) Sucofindo shall be stipulated in a working agreement between the government in this case the Ministry of Finance and PT (Persero) Sucofindo.

Article 5

(1) The fees for the surveyor shall be borne by the State Budget of Income and Expenditure.

(2) The fees as meant in paragraph (1) necessitate exporters applying for inspection of export goods to submit copies of PEB/PEBT already approved for loading by the Directorate General of Customs and Excise to PT (Persero) Sucofindo not later than 30 (thirty) days as from the issuance of LPS-E.

(3) LPS-E and copies of PEB/PEBT already approved for loading as meant in paragraph (2) shall be submitted by PT (Persero) Sucofindo to the government in this case BAPEKSTA-Finance.

(4) Exporters failing to submit copies of PEB/PEBT as meant in paragraph (2) shall bear the fees for inspection based on generally effective tariffs, which are directly collected by PT (Persero) Sucofindo from the exporters concerned.

Article 6

(1) With the enforcement of this decree, the Decree of the Minister of Finance No.857/KMK.01 /1993 shall be declared null and void.

(2) Especially with regard to the payment of fees for containers already inspected by PT (Persero) Sucofindo before the enforcement of this decree, the following provisions shall apply:

Article 7

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
